Is illegal for my employment application to be used by employer for personal use?


Recently I applied for a job at an staffing firm. While filling out the employment application I noticed outside that my parked car was being hit by another car trying to park beside it. Just so happens that the woman driving was a recruiter at the firm. She was very hesitant about sharing her insurance info. with me. She did not ask for my insurance info. nor did I fill obligated to give it to her. The only info. that was given by me was my name and the make and model of my car. Later that day I contacted her insurance company to give them my info and they already had my name and "address in the system" and other personal info already. I have no doubt in my mind that this info. was obtained and given to "her' insurance company from the recruiter by way of my application. I think that it was a very bad business practice. I've called the firm several times but they will not give me a number to anyone that can i voice my complaint. This has to violate some type of privacy law.

Well, I agree that you should make a formal complaint but also, allin all-you need to give that info anyway to her insurance so its ok that she did-just kind of rude. She should have called you and asked permission-

All of this information is attainable through your license plate number. Insurance companies have all licensing records available to them.

It really sounds like that the staffing firm gave that woman your information. OR...she probably jotted down your license plate information and the insurance company obtained your information thru the DMV. Since no one wants to be up front with you about how your information was obtained, I would (to be on the safe side and to protect your rights) contact an attorney to help you in this matter immediately!

Try to remember did you also give out your driver license number to this person. If you did, the insurance company can can easily put a DMV report from it. The DMV report would have your name, address, contact information, and insurance company record. Your car license number will only show who is the registered or legal owner of the vehicle. Some states may have your insurance company information since insurance company may report it to the DMV.
The next question is can you proof that she had used your information from the application? If you intend to hire an attorney, it will cost quite a lot of money to investigate about what you claimed. Most recruiters and their companies know the law which prohibits of use information from emploment application for personal use. You can assume that she had used that to gain access of your personal information. You could end up being sued.
