Can a realtor terminate a listing agreement because they do not want to advertise as they promised?


Agent got our business by making specific promises in a marketing plan addressed to us and we went with the listing price she suggested. She has not done this advertising and when we questioned her about it she ignored her lack of performance and just said we had to lower the price. It's only been listed a few months and almost no marketing done. Then we get a phone message saying she has terminated our listing agreement. No meeting, no discussion, just left a message pulled her sign and cancelled our MLS within 2 hours. Doesn't she have a duty to us till the listing is expired? And wouldn't this have to be in writing and with our agreement?

We have a clause in our contract that we can cancel at any time if we are dissatisfied, but if we change now, we have lost 3 months and have to get new pictures and video tour so will lose more time. I think she should at least give us the tour and pictures since she wasted our time and since the market is dropping, might have cost us money with this delay. I am also angry that we have been treated this way.

YOU are 200% correct!

YOU have easily 3 routes for complaint:

a; her RE broker,
b; the local office of NAR,
[national assn of realtors];
c; the state office of real estate
for licensure-- for violation of the
RE salesperson's ethic's laws.
[not counting violation of the contract
that you correctly pointed out]

That is a violation of the contract. However, I wouldn't want to work with that Realtor after this incident.

Is this a joke? Sellers are usually asking how to dump their non-performing Realtor, not how to keep the non-performing Realtor. Call up whoever was your #2 choice and tell them you're ready for a real Realtor to help you. Let them know what #1 did wrong - it won't happen again.

Do have them do a current market analysis - the times, they are a changing.
