How can you file a small claims lawsuit against someone if you don't know their address?

I have a small online business and gave an a friend of a friend some merchandise with the promise he would pay me the next time we met. That was 6 months ago and he still owes me the $80.

I know his cell phone number and place of work but do not want to have to visit him there. He is ignoring all calls and emails and still owes my company $80. It's a small amount but I want to don't think he should be able to steal from me without paying.

The only idea I have would be to pay $30 to have an online company research his current address (he has moved in with his fiance) but was hoping to get any ideas. If it went to court it would be a slam dunk (I have all of his emails of him accepting the agreement of $80 for the merchandise and his follow up emails apologizing for not paying for the first couple of months).

Add the costs of finding him to the collection accounts and add it to the lawsuit.

Sell the debt to a collections agency and they'll do the rest.

You could try to have the courts supoena his billing address for his cell.

Otherwise, hire a Private Det...

Incidentally, once you have the judgement, YOU are responsable for enforcing it.

Have the friend of the friend know that you're going to give him a week to pay you...in full, or you'll have him charged criminally with Theft by False Promise and Breech of Contract.

Free Lesson...in many jurisdictions, if you don't have a License from your Province/State to sell, the buyer has 1 year to request his money back for being unsatisfied with the poroduct...and you'd have no recourse, provided he returned the product to you.

You do not have to have the address of the defendant in order to sue him. In fact, you don't have to have his name; you can descibe him or his characteristics as the defendant. In your complaint, simply list everything you know about him such as his work address. Your process server may serve him at his place of business, then mail him a copy of the summons and complaint to his last known address, or his place of business. Consult the clerk in small claims court. Good Luck.
