Are ADA complaintants required to send a complaint letter directly to the landlord or building owner?


Are ADA complaintants required to send a complaint letter about ADA access violations observed in a business, restaurant, or other place of public accomodation, directly to the building owner's business address before filing a lawsuit?

Or can the ADA complaintant just send the letter to the tenant's address and also list the building owners name on that same letter although the building owner does not work or live at that address.

filing a complaint with the city dept of building inspectors and zoning enforcement will usually get a quick response. The .reponsibility lands on the property owner to comply with all zoning and building codes. All you need to do is call the local governments building dept, zoning enforcements they will actually visit the site and enforce the local building laws for adjustments.

The complaint needs to be sent to the person with the ability to make the repair. It depends on the nature of the problem.

Filing a lawsuit without notifying the proper party is perfectly legal but quite stupid. It would basically be like the court notifying them for you, and charging you for it.
