Does it matter if I use my house address for my LLC? |
I am registered my LLC using my house address and my DBA under the business address. If my business gets sued, can they take my house being that it is listed as the address for the LLC? I can't see how it would matter. They can't take your house because it is the LLC's address (they could if the LLC wasn't set up properly or something, but thats not the question). FYI, I have several LLC's and always use my house address on those. Note I've never been sued (ie never had to test this out) but 2 different lawyers set them up this way so assumedly they would've known better. Don't you have a lawyer that could answer this for you? I would think it wouldn't matter but I'm not a lawyer. All things considered, no. But if you depreciate some of your house, their will be consequences tax-wise when you sell it if there is a gain or loss. If your company is sued, and no portion of the house is owned by the company (meaning you didn't take a depreciation deduction on the house itself), then they can't take your house or put a lien on it. If you use a portion of your house for the business, be sure to charge the LLC rent. That keeps the 'corporate veil' in place. The LLC can make improvements that can be depreciated and the ownership remains with you personnally. Check with a lawyer, but I don't see how your house would be at risk unless the LLC owned the house. |
