Can I have 2 businesses registered at the same address?

I have a small retail shop and my brother is trying to set up his own company, can he register it at the same address as my shop and work from upstairs?

To be safe, ask your county clerk or tax collector's office whether your brother could set up his business upstairs. It could be that his type of business might not comply with zoning laws in you area.

Whether you own your space or you rent it, you should set up a contract with your brother to lease or sublet upstairs. (I'm not really sure whether a landlord can prevent a tenant from subletting a commercial space.) And seek legal advice, or ask your business insurance carrier, about liability issues, i.e. if your brother's customer slips or falls going upstairs or in his office, who's liable?

Sure as long as he gets a buisness licence and is registered with the local tax collectors office.
The only way it may not be allowed is if the building is specifically zoned for only one buiness... that you would have tp check with your counties zoning department.

If the businesses are sole proprietors you can have has many as you want at one location. If you are incorporated and he is not that is kay too as lonaas he is not using the same space you are and taking a deduction for it.The boundaries of the business areas must be clearly separate for business deductions.
