If we have a party at our home which also is our business, is the business at risk if someone gets hurt?


We're planning a big party. Lots of people bringing their own liquor. Since are business is based at this same address, if someone gets hurt here or God forbids leaves the party and hurts someone else on the way home, are my husband and I personally and or is our business liable? Are we risking our company by having this party?

Not if it's after business hours. after that it is a home. so business is not responsible.

Absolutely. As long as the business is consenting to the use of space for social purposes, anyone who gets hurt can sue you (and the business) for losses.

It depends on the state in California you are not liable for serving alcohol, except when the person is obviously intoxicated, or the person is a minor. Under negligence theory you have a duty to act reasonably in your conduct, you are not required to control other person's conduct. If something is foreseeable, if you know it is likely to happen or a high probability that it will happen, then you are liable. If you have an LLC or corporation, the business is safe, unless you commingled. If you don't serve or provide the alcohol you are okay, as long as you don't do anything dumb. Liability is always a question of negligence and punitive damages requires intent or extreme recklessness. If you are careful and your behavior reasonable, you are okay. If encourage people to down a couple for the road, you might be liable.

Yes, you are risking the company.

When somebody gets hurt at a site, the lawyers' rule is "Sue everybody". The Judge figures out who is liable, ad Judges can decide anything they want.

Even if you're found only personally liable, if you own the company, the creditors can force you to sell or liquidate it to pay off the damages.

You can always be sued.......The question will be is the party for business reasons? Are you using company assets? A good attorney could argue either way...I would consult an attorney for a more definitive answer.
