Business evicted after 15 years of renting the same space?


My dad has an electronics repair shop that's been open since 1992, always been in the same location and this month received a 30 day eviction notice. The landlord has given him a one year lease for 14 years but then in December there was no lease sent to him. He didn't think anything of it and as always, ordered more business cards, took out year-long ads, etc.

He went down to the management office to find out what happened, and they told him someone else offered to pay twice what he is paying and sign a 5-year lease too. They didn't tell him this in advance or offer him the same deal first, only told him after he went to ask why he was being evicted.

Needless to say, this is messed up. He's been in business for 15 years and now basically has to close up shop within 30 days, no time to find a new place, install all the equipment he needs, let his customers know he's moving, correct the address/phone number on his cards and advertisements, etc.

What can we do? Anything?

Did his old lease provide an option for renewal?

You really need to take a good look at his old lease and see what renewal options or provisions are in there, and also what the notice requirements are for non-renewal or termination.

nothing much you can do about this in the short term.....unfortunatly it sounds like you will be out of business for a while..... find a location as soon as possible.... settle in and then maybe find a lawyer and discuss legal concepts with him /her... maybe you can end up suing the landlord for not giving you notice in advance in such sircumstances....... if that cannot be disputed then..... this will be the downfall in your business sorry to say......There is another thing that you can check on - check with your Business insurance - maybe you are covered for something like than, no likely because you are not suffering from any damage but you financially... so i dunno still check

check the real estate contract. He signed it. Does it give a clause for termination of the lease or give a notification for non renewal of lease?
Your dad should not have taken it for granted and he should have been on a 5 year lease anyway to lock in his price.
He knows he messed up.
Look to the lease agreement. If he has any way to stop this, it will be there, or in the law. (doubt if the law has much to do with commerical leases though)
