Does a business have the legal right to give out personal information to anyone who asks? |
The local bike shop gave out our personal information to a dangerous relative that we've been hiding from for 6 years. Now he is now harrassing us by calling and threatening to "visit". Is there anything we can do? Does a business have the right to give out a customers home and cell numbers along with address? You could sue them for damages, but the likely hood of them having very much to pay you is slim to none. Change you phone numbers and report the harasser to the police. A business does not have the right to give out personal information to anyone without the persons consent. If you did not give the bike shop consent to give out your personal information, you need to hire an attorney and take the bike shop to court. You should also seek to get a restraining order to protect yourself and family from your dangerous relative. No they do not. But it's difficult to recover damages for release of information. Absolutely not! Get a lawyer on the phone and a restraining order That is strictly illegal on a state and federal level. Get proof and sue them. No, however there isnt much recourse you can take. Was it a mom and pop shop? I bet the relative gave them some sob story to get the info. no, you should get a good lawyer and sue that business. make sure you can pin down exactly who in the business gave out the info. some stores can always say the employee does not work there anymore, thereby absolving them of fault. He doesn't have a "right" to give out your contact info, but nor does he have a "duty" to keep it private, UNLESS you had some sort of contractual agreement that said so. |
