If I am starting a business as an attorney, do I have to register as a PLLC?


I would like to start taking cases in Arkansas, but would I actually have to register as a PLLC? Would I still be able to get clients, take money (specifically retainers), etc., without being a PLLC?

In the alternative, if I did have to register as a PLLC, would I have to have an actual physical address? I would prefer to just use my PO box, especially since I have not acquired office space. I would actually be accepting clients on a part-time basis, doing research at the library or at home, until I could afford to get office space. I would really prefer not to have to get a permit to use my house as a business.

Are there any alternatives that I am just not aware of? Any help is appreciated.

You will need to speak with a corporate attorney to determine the specific requirements for your area. Most states do not require a formal corporate/Scorp//LLC/PLLC et al structure for an individual to start a business. However, depending on your region, you will most likely need to get some form of a business license and possibly meet other formal licensing (and possibly location) requirements. A Corporate, S corp or LLC/PLLC structure is not intended to encumber you, but rather to limit your liabilty re recourse and tax liability. You should also talk to a tax advisor to determine the best tax strategies to employ for your region and your business.

It seems strange to me that an attorney 1) would have to ask that and 2) that he would ask that here. An attorney taking advice from the general public?

Man, I hate to say this, but if you are starting business as an attorney, shouldn't you be able to answer this question?
Just think of it as your first client, and go ahead and do research that is necessary, but this time do it for yourself.
One more thing, if a client comes with a problem, you are not planning to use Yahoo Answers for them, are you?

If you need to ask here, you can't be much of an attorney.
