Comcast Double charged my debit card and won't refund.?


I do not have a bank account. I have a Debit Card account. No buildings or branches. I cant get a checking account because i was thrown into a bad financial situation and over drew an account and never paid them back. So now i get my pay put on a debit card and pay my bills through that. Comcast double charged me and said to refund me they have to have a fax from the bank. the "bank" won't send faxes to 3rd parties. Now I have no money to buy gas or food or pay other bills, like my insurance. Double dipping is illegal, its unauthorized, and its theft but the "bank" won't speak to comcast. I want to sue comcast and I live in Valparaiso, Indiana. What office do I have Comcast serve the papers to for small claims? I know $90.61 is a small ammount but it was supposed to last me the whole week for gas food and insurance. I can't even buy gas to get to work tomorrow, so now i have to call off (i have no friends to take me and its too far to walk). What can i do? I need action!

also, since comast made it impossible for me to buy gas to get to work, can i sue them for lost wages? I live paycheck to paycheck and i never save any money at all because im poor. emergencies shouldnt happen. im entitled to sue them for more then 90.61 right? since i cant buy gas to get to work

At this point, your best option is to keep going up the chain of command at Comcast and at your bank. You could file suit in small claims court, but you would have to come up with the money for filing fees and service fees, which could easily be more than the amount you have been overcharged.

You would not be eligible for lost wages. It's not Comcast's fault that you failed to plan ahead & save. I know it's almost impossible for most people to set aside any money once they pay all of their bills, but, if your financial situation is so dire, you probably shouldn't be spending $90 a month on cable. Their actions did not PHYSICALLY impair your ability to work. You can file a complaint with the BBB. That might be enough to get them to look into the problem and remedy it.
