Is a sick day policy required by companies in Texas?


Our corporate office is in NJ but our branch is located in Texas (where I am). I've been having problems with my boss since I told him I am pregnant. Now at 20 weeks I have the flu and he insists that I find a "solution" and be at work every day and be well. How can I do that? Every one is bound to get sick, and it's important that I stay home and take care of myself... it's like he wants everyone to catch this crud! Finally I called the doctor and got a note and a prescription to shut my boss up. It's been really hard to prove a point though because there is no HR department in our office. No handbook going over the rules and regulations of the company... and the best explanation that I can give on our sick day "policy" is that we have them when we need them, but shouldn't abuse them. How in the hell can I win with them if they don't have a handbook? It's like they're constantly changing the rules!

If your company has a corp office there is an hr dept and a policy and proceedure manual SOMEWHERE. You may need to call your corp office in NJ to find this info. The policies will be whatever the policies are of the corp office in NJ.
Likely if you are full time you are entitled to sick leave and fmla. However, there are very specific proceedures you need to follow in order to take this time. You will need the corp policies and proceedures manual to know those things.

Somewhere there is an 800 number for someone at the corp office you can contact that can help you. You need to find that number and talk to that person.

In the event your employment status does not entitle you to sick leave or fmla, then there is likely nothing you can do aside from go on unpaid maternity leave now rather than later. And even then they are only required to hold your job for a certain amt of time, 12 weeks I believe.

You may also want to speak to a labor law lawyer. Most will give free consultations.

There is a reason large companies have offices in "right to work" States. They can pretty much do what they want. As stated, the corporate office has some sort of handbook and you will need to contact them.
