Help! Already hold a H1-b but never use it. Will I be counted again in quota when apply a new H1-b? |
I apologize I didn鈥檛 write my question clear at the first time. My question is I got the H1-b visa approval filed by company A recently, and it will be valid in Oct. I currently work for company A in OPT status, but not in H1-b status. Now, I have to move to another state because of a family issue, but the issue is not regarding to immigration. Nobody depends on me for a visa. I know I will have to apply for a new visa after moving to another state, even though I may still work for company A just in different branch office. Whether I will have a problem to apply the new H1-b, if the H1-b visa cap is reached at that time? In other words, I already have a H1-b even I never work with it for one day. Will I be counted in quota again, when applying 2nd H1-b? Thanks. Yes, you will be counted again. The quota is for visas issued, whether you actually use it or not. |
