Is it possible to bring a class/group action in tort in EU?


A(Seller-Belgian Co) enters contract with B(Buyer-Danish Co) whose main office is in Denmark and branch in England. C(Scottish) was in England and buys this food product from B's branch, falls sick in England sent to hospital there. When C returns to Scotland, C wants to sue.
At the same time, D(Danish) buys same food product from B's main office in Denmark for D's aunt (E) who is a German. However, D bought E, B's goods as a gift, hands it to E in Amsterdam when D & E were there on holiday. E consumes B's product in Amsterdam, falls sick, returns to Germany for treatment.

QUESTION:
Can E and C bring action against B? C can bring action under contract, but what about E? Tort? Can C & E bring joint/class/group action suit against B since both E & C suffered the same problem after consuming B's product...

First, you would need to prove that all these people feel ill from the same, not similar, food from the same lot number. If all these people became ill from the same lot number and a Motion is presented before the Court to deem this as a Class Action, then is it can be done. Otherwise, each individual can file their own lawsuit against the corporation for a tort. In addition, it may not be the product, it may be the manufacturing plant.

Keep in mind, however, that each jurisdiction has its own rules.
