I have this problem with a bank, can I sue them? |
Basically I have a loan with them. I asked for the due date of the loan to be changed to a later date. The branch manager told me that she will do it for me within the next couple days. Well, she never did it and she went on vacation for 2 weeks. I tried to call other members of the branch, but they kept giving broken promisses. The manager came back from vacation, I tried to contact her, but it seems everytime I call, someone would tell me she is at lunch or out of the office. 3 more weeks later, I called the cust. svc. center and complained, then she finally e-mailed me back saying that she had changed my due date for the loan. BUT SHE LIED! It was not changed! I called a different branch and a cust. svc. rep told me to write a letter requesting the change of the due date and he would help me. I wrote a letter, and 3 weeks have passed and he too has given me the run around. It has been nearly 4 months and still no one has helped! Can i sue/do something meaningful to them? I know anyone can sue anyone, but my main question is, do you think I can sue them and win? I have the e-mail from the manager stating that she changed the due date of the loan, but she lied and never did nearly 2 months ago. As of today, still not changed! Yes, deregulation has been very disappointing. Banks can now do or not due what ever they want. The excuse at the time was that if you don't like what a bank is doing, just change banks. How much longer do you plan to waste your time using the phone? You need to be documenting this. Yes, go there in person, or start using letters (written documentation of agreements). If you sue, what are your damages? No, you can't sue them. For a lawsuit, you have to have proof, and you have to have damages. This has not "harmed you" in any meaningful/legal way. Well for one thing she is avoiding u with putting everyone is her path to block from talking with u-n- if they did not follow through on ur request n depending on what state u live in,like my state of New Jersey,I would contact the New Jersey Banking Commission in the state capital of Trenton,n they would go after her and the bank if u have that in ur state than go for it because it is obvious she is not doing her job but is doing a good job of avoiding helping the customers out for so check n se if u have a state banking commission which most states do that regulate banks in that state n investigate problems with banks and complaints from consumers that will get her pantie hose twisted when she learns they are coming after her be sure u have copies of all correspondence u did it getting this resolve phone calls u name it,it will all work in ur favor if u have all of this document even the littlest thing than they cannot come back n say we did not n-u can say yes!u did n got the proof to back up my claim. I really doubt it. You signed the loan papers agreeing to the due date. If they said they would it would seem nice of them but I doubt they are required to. |
