Is Congress' investigation into the firing of US Attorneys a violation of Constitutional separation of powers?


Serious question regarding separation of powers.

Although US Attys are appointed with the advise and consent of Congress, their employment is primarily subject to the whim of the Executive branch - they can be fired by the Administration for any reason, or even no reason at all. For example, when Clinton assumed office, he fired ALL US Attorneys and appointed new ones of his own. Not a big deal - it's part of the political spoils system.

So, does Congress have any business looking into the Bush administration dismissal of these handful of US attorneys? Does this fit within their Constitutional purview? Does it have precedence?

Yes, congess can investigate it. That's the point of the separation of powers, no no one branch hold it all and can be questioned/investigated by others. I think that the suggested investigation is about a pattern to the firings, rather than about the fact that thaere were firings.

If there's a potential scandal then it would be fair for Congress to look into this issue but the National-Union believes it is the judicial branch area to review the reason why the administration is firing the US Attorneys. Their case should be handled by the Courts to see if it is constitutional. The legislative branch is suppose to investigate unfair laws and correct policies, http://www.voteprimous.com

The administration in power was elected and should have the right to hire / fire anyone as long as it is within the law. In our system of government we have the chance to vote for who we want in office, and should let them do their job. We now spend way too much energy whinning when we lose instead of taking care of the country as a whole.
