What does amendement 5 actually mean?


No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Can anyone tell me what it means in plain english?

-Right against self-incrimination
-Eminent Domain

1. You cannot be tried for a felony without being indicted by a grand jury, unless you a soldier who is fighting in a war.

2. You cannot be tried twice for the same crime. If you are acquitted, then the state cannot try you all over again.

3. You cannot be made to testify against yourself.

4. You can not be executed or put in prison without due process of law. This means that you have to be indicted, tried and convicted.

5. The government cannot just take your property. For example, if the government wants to build a park, and wants to take some of your land to build it on, they have to compensate you for taking it.

You have the right to now say anything as to not incriminate yourself. You cannot be convicted of the same crime twice. You have the right to life, liberty and property and these items cannot be taken from you without due process of the law. Do you know what due process means? it means, the principle that the government must respect all of a person's legal rights, instead of just some or most of those legal rights, when the government deprives a person of life, liberty, or property.

It's actually the "guts" of the U.S. Constitution. You're familiar with "the right to remain silent". That is your right not to be compelled to be a witness against yourself. Your right not to be bullied by the government. A right to a trial by jury. NEVER, EVER WAIVE THESE RIGHTS!!!! They are there for your protection.

No person shall be held for a crime punishable by death or loss of property unless put in front of a grand jury This applies to all people except those persons in the armed forces during a time of conflict. No one will be tried for the same crime twice, and none of their property will be taken without a full trial and full compensation.

1. no capital punishment without a jury.. unless its a military trial

2. can't be tried twice for the same crime

3. can't force a person to testify against themselves

4. can't put someone in jail or take their property without a court process.

5. the government can't take a person property without paying a fair price for it.

there's a few things commonly used from this.
1. right to a trial
2. no double jeopardy
3. right to remain silent
4. immenint doamain, right to property but also a clause to allow the govt immenint domain and take land so long as they pay 'just compensation'
5. Another time relevant bit is about rights to trial with the exception of naval, military and times of war. Bushco's loophole to not try suspected terrorists.
6. Also allows the denying of life liberty and property so long as some "due process of law" is followed.

It basiclly spells out how you can be arrested or what rights you have to be arrested, i mean rights to not be arrested with out proper procedure. It does strike me about something someone said about the laws of the house are stacked against us. It always in thier favor, so while it appears to be a contract or right of ours, it does in fact spell out our demise, kind of like these are your rights up untill we take them away or these are the rights you are allowed, all the rest of humanity is out, only what's included in this bit is your right. Only what we allowed and spelled out. What greater a way to sell you your own chains than convince you it's for your good.
