divorce in court by the state of FL. He now resides in IL. We are both looking to get married in a Catholic service, because I am Catholic and he is willing to go that route. I have never been married. Does he need to get an annulment for his previous marriage in order for our marriage to be recognized? He has proof of his divorce, ie, papers. who grants the annulment? the Catholic church or his non denominational church? he doesn't even attend his services, he's registered at my catholic parish His lawyer advised him to divorce being it would be cheaper and guaranteed rather than annulling the marriage because it would be forever on the shelves! I have been told that we can marry but only a blessing will be granted-is this still considered a legally/religiously recognized marriage? I know we can't get communion because he's not Catholic at the church ceremony. The catholic church must also process an anulment if you want to be married in a catholic church/service. The church's annulment is its own thing - completely separate from the legal divorce. You should really call the Catholic church you plan on getting married at, and ask them what steps you have to take to be married there. I know if you get married in a Catholic church, get divorced, and then want to get remarried Catholic, you have to get it annulled, but I don't know how it works if the first wedding was non-catholic. I don't know the exact rules, but my cousin's situation sounds like yours...she's Catholic, he wasn't. He was previously divorced, she'd never been married. When they looked into getting married, she was told they'd have to have his first marriage annulled, which would entail (among other things) his ex wife having to go in for an inquest (she's Baptist!) and if they felt there were sufficient grounds, they would grant the annulment. They didn't feel right asking the ex-wife (since remarried) to go in for the inquest, so they opted for a non-denominational service at a chapel. It was very lovely. Anyone (Catholic or Non-Catholic) who was previously married and who wants to remarry in the Catholic church must discuss the circumstances of their former marriage with a priest to determine if an annulment or nullification of the previous marriage is necessary. Getting an annulment is a process, you need to sit down with the groom and a priest and discuss this. If he is not Catholic but is willing to convert I don't think there are religious implications but ask anyway. Just remember before all organized religions and man and a woman chose each other made their own vows and honored them. You really need to decide if the joining of your two lives is more important than the recognition of the marriage by a church. I promise you can still have a church wedding with your priest presiding, but slow down. Examine the issue and then put on paper some of your concerns then make the appointment to talk in depth with your priest. I was in a similar situation, I was married for a short time when I was much younger. I am now getting re-married in a catholic church and had to get an annulment. ( I wasn't catholic at the time of the first marriage OR during the annulment, although I have since converted). The process was not as difficult as I thought it would be, nor was it all that expensive. I believe I paid $150 total and it took about 4 months. Call your priest and set up a meeting to discuss your marriage plans and see if you guys would be eligible to marry in the church. If you can with an annulment, the priest will sit down with your fiance and answer some questions in a packet which will then be forwarded to your local diocese. If he does not get an annulment, I am not sure how that work or if they'd do it. You could just not bring it up. If the state says he's divorced then he's divorced and the marriage is no longer valid. I doubt anyone would check. |
